Agreement

By using DetentionGuard Pro at https://detentionguard-pro.web.app, you agree to these Terms of Service. If you do not agree, do not use the app.

What this app is

DetentionGuard Pro is a driver-operated tool to record detention time, build reports, and help you document pay claims. It is not your carrier, employer, broker, payroll department, or legal representative.

Not legal, tax, or payroll advice

Nothing in the app is legal, tax, employment, or payroll advice. Detention rules, free time, rates, and pay eligibility vary by carrier, contract, lane, and facility. You are responsible for understanding your agreements and applicable law.

Accuracy depends on you and your carrier

Report accuracy is directly proportional to the information you enter and to your individual carrier’s policies, contracts, and payroll practices. The app does not verify rates, grace periods, facility rules, or whether your carrier will pay a claim.

Wrong hourly rate, grace period, email address, timestamps, load details, or signature will produce wrong reports. Review every report before you send it.

Your setup responsibilities

Before relying on payroll email, history, or earnings summaries, confirm:

• Your driver email and carrier / payroll email are correct
• Your hourly detention rate and free-time (grace) hours match what you intend to claim
• Your digital signature is yours and acceptable to your carrier
• You understand how your carrier accepts detention filings (email format, deadlines, portals)
• On iPhone, you use the home-screen app icon if you installed the PWA — Safari cache clears can erase local data

Reports and email

When you use “email to payroll,” you initiate send from your device. We do not guarantee delivery, read receipts, or carrier response. You are the sender; verify recipients and content every time.

GPS and photos

Optional GPS and photos are aids only. Signal loss, wrong tap timing, or incorrect facility association can affect location text in a report. Do not rely on GPS alone as proof without your own verification.

Pro subscription

Paid Pro features are billed through Stripe (monthly or annual). Subscriptions renew automatically until you cancel in the Stripe customer portal. Free trial and promo periods are described in the app; eligibility and length may change.

Refund requests follow Stripe and our support policy; we do not guarantee refunds for unused time after subscription activation.

Creator & referral programs

Separate partnership, referral, and profit-sharing programs have additional rules shown in the app and admin agreements. Creator payouts require valid Stripe Connect onboarding and qualifying paid subscriptions.

Disclaimer of warranties

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ACCURACY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR LOST DETENTION PAY, MISSED DEADLINES, CARRIER DISPUTES, DATA LOSS ON YOUR DEVICE, SETUP MISTAKES, OR INDIRECT OR CONSEQUENTIAL DAMAGES ARISING FROM USE OF THE APP. OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM (OR $50 IF YOU HAVE NOT PAID).

Indemnity

You agree to indemnify and hold us harmless from claims arising from your use of the app, your reports, emails sent through the app, or your violation of these Terms or third-party rights.

Changes

We may update these Terms. The “Last updated” date will change. Material changes may be noted in the app. Continued use after changes means you accept the updated Terms.
